Stallion Service Contract

This Contract for the breeding season of 2008 by natural or artificial insemination service to the Paso Fino Stallion, Apache de Ventura, PFHA # 88,132, made and entered into by Roxanne Kay Miller, herein designated stallion owner and the mare owner _________________________________________ on _______________________.

The stallion service fee is $ . The amount of $ will be paid upon the signing of this contract and / or the receipt of the stud collection, and the balance and all other unpaid charges will be paid before the mare leaves the breeding farm or when the mare is certified in foal at 30 days by a certified veterinarian.

The Stallion Owners / Agent Agrees:

1. To provide blood typing and registration of the stallion in accordance with the PFHA rules.

2. To provide a signed registration application for the unborn foal upon payment in full of breeding.

3. To guarantee a live foal provided that the mare shall have been pregnancy check by an licensed veterinarian who shall certify the mare to be in foal. In the event that the mare who was pronounced safe in foal does abort her foal or bear a foal which fails to stand and nurse, as certified by a certified veterinarian, the mare will have return breeding at no additional stud fee, good for the following calendar year only, and represents the full completion and satisfaction of the guarantee for live foal. In the event the mare owners fails to rebreed the following year, the stud fee and all other charges paid hereunder shall be non-refundable and the return privilege for rebreeding shall be null and void.

4. To see it that semen is shipped for use in a timely manner after notification that the mare is ready to be bred.

5. To cancel 1/2 of the stud fee and withdraw from the contract if after four heat seasons the mare has not settled in foal.

6. To have all veterinary care or any medical treatments approved by mare owner, except in case of emergency.

The Mare Owner / Agent Agrees:

1. To provide a copy of the mare's registration and to follow all the requirements set forth for foal registration.

2. To present the mares in good health and in clean and sound breeding condition.

3. To pay all expenses associated with the collection of semen, live cover or A.I. services.

*A non-refundable charge of $25.00 per heat cycle for Live Cover Breeding

Handling Service. (This includes teasing and hand breeding the mare). This

must be paid before mare leaves the facility.

*A non-refundable charge of $70.00 for each shipped collection. (This will cover

supplies and collection services.

*A non-refundable charge of $100.00 for A.I. service. This will cover insemination,

supplies and one collection. (one collection will provide enough to A.I. twice).

This must be paid before mare leaves the facility.

4. To pay all Fed-Ex or Air Freight Shipping, Handling or Return fees of $___________. This charge will very according to shipping address. Payment must be made prior to shipment of semen. The shipping container or Equitainer is the property of Hacienda de Molinero, Inc. and shall be returned within 3 days after the receipt of the semen. A charge of $15.00 per day will be charged if the Equitainer is received after this time. If the Equitainer is not returned a charge of $350.00 will be applied.

5. To palpate the mare so that her heat cycle may be anticipated and to advise the stallion owner of a probable ovulation date in time for semen collection to be sent to Mare owner.

6. To have a certified veterinary perform the insemination procedure.

7. To grant a lien on the mare (and any foal conceived in this contracted breeding) in the event payment of any portion of the stud fee or other charges are not timely paid, in the amount of the unpaid charges owed to the stallion owner and any legal fees incurred in the process.

8. To pay all non-refundable mare care charges of $12.00 per day before the mare leaves the facility.

The Stallion Owner may request at anytime a negative culture test and / or any other test (at mare's owners expense) to verify the breeding condition of the mare. Should the stallion or the mare die or become unfit for service prior to initial breeding, the stud fee shall be returned to the Mare Owner.

It is understood that the mare owner shall assume all responsibility for the condition of the mare and shall bear all risk of loss or damage to the mare whether by death, injury, infection or otherwise, and by any cause whatsoever, and therefore agree to hold Hacienda de Molinero, Inc. it owners or any person employed by or associated with Hacienda de Molinero, Inc. harmless for any and all damages associated there with Hacienda de Molinero, Inc.

Payment of Cost and Attorney Fees:

The mare owner shall also pay forthwith all costs, charges, expenses and disbursements of the stallion owner / agent, including all attorney's fees incurred in securing payment of such breeding(s), or any part of same, or in any proceeding action concerning same, or looking toward the protection for the stallion owner / agent rights or collection of the monies owed or any part thereof.

This contract is not transferable or assignable by the mare owner. This contract contains the entire understanding of the parties. This contract is made and entered into in the state of Missouri, and shall be enforced and interpreted in accordance with the laws of the said state.
